You can't say that FAR has had its chance to preempt, and in the same breath say that FAR do not have the right of preemprion because WPL only bought the company holding the interest and not the interest itself.
There is too much now in the public domain and the rope will be long enough for WPL to dangle from soon.
FAR Played a clever game of staying quiet while each of its JV partners showed the cards they were holding. I don't think CNE have come out of this without some stains on them either
