Am I right in recalling that during the asbestos fight with James Hardie, a few years ago, the general principle was accepted that an entity couldn’t on-sell their company and avoid compensation responsibility for injuries caused by asbestos used by their former business? As asbestos installed by the business now known as Telstra was installed when it was part of the Federal Public Service (PMG) or fully owned by the Federal Government (Telecom), wouldn’t the same principle apply? Surely the Government must bear some responsibility for the danger caused by installing the asbestos in the pits and ducts now owned by Telstra. Why hasn’t this been mentioned by anyone involved?
