The other thing to think about if this matter gets to court. Perhaps the court may take an average of the share price over the period in dispute. IMO I do not see the court making this a one way street and that the creditors would have sold at the top on the period. The fink made his feeling pretty clear that the Opes Prime creditors now want damages from the 27 March as the market has fallen, but if the market had gone the other way, a different outcome to suit their books. As much as eveyone wants the perfect and highest dollar outcome for their position, the courts may be a little more subjective, and take in to account other criteria in its assessment for damages. Itis possible it may even look back to before the M&D actually took place.
