So basically it is happening, everyone individual who follows the market can see it happening daily, but the ASIC can not see it happening but then after it happens they may be able to see that it may have happened and maybe they may be able to do something or maybe they won't depending on if it did or did not happen as they could not see it happening ...
Maybe like the AFL umpires the ASIC should get sponsorship from OPSM lol
