It seems to me that under these updated rules, nothing changes at all.
They will have to make a downstream offer for EXT because its a 'significant purpose' of the upstream acquisition of KAH
i.e
'a mere ‘artifice’ with the true objective being the acquisition of the downstream interest.'
Nothing else in the report releases in any way, any bidder for KAH from making a pro-rata offer for EXT.
Also a further impediment to CGNPC getting an exemption from these rules is the fact that neither the AIM or the Namibian exchanges are approved by ASIC for any relief what so ever.
