you are really missing the point.
The issue was not whether the contract was terminated, it was whether they could rely on 3.1a as a defence under those circumstances not to declare it to the ASX.
like all things, the onus is on the ASIC prosecutor to prove they couldn’t. He spent hours trying to do it yesterday and in my view got nowhere near it.
