How is a journalist's column (let alone this line of attack overall) relevant and admissible as evidence in the ASIC v ISX & Anor? Anything remotely approaching this will be objected to. Keep things simple and in line with the case as pleaded by ASIC. The focus of the Defendants is hopefully on that, not what ASIC did or didn't do in relation to other unrelated matters. Simple example, if police bungled one or more investigations into a matter, do you do throw the baby out with the bath water and toss out every police prosecution? Of course not. You look at each case on it's particular merits.
