    We have to also consider that so far in court we have had appearances from ISX’s witnesses (and less from ASIC’s witnesses). Their written statements have been previously disclosed to the courts, but we have not heard or seen all the details in their statements. We have seen plenty of time spent by ASIC’s KC trying to tear holes in their statements. Thus all us observers of the court have limited information of what has been presented to the court.

    I was also curious about the way the ISX KC was seeking to limit what new information ASIC may present in the future.
    I will be interested in seeing the pleadings and opening statement presented in defence of JK tomorrow.
    Will their be some new information presented which ASIC is unprepared to defend, and possibly limited in their actions?
    How much has the defence refined their arguments now knowing the line of attack by ASIC?
