    ASIC nuke companies not spank them. PUN :P

    The way I see it, 2 scenarios that both end the same.

    PEN are in the wrong... we lose.

    PEN have done nothing wrong but ASIC investigation announcement would destroy SP further, hurt potential business relations during the investigation and cost us a fortune... we lose.

    IMO of course.
