generally, it is not the actual holder that loans out the stock for shorting. it's generally the custodians that loan the stock out.
standard contracts with custodians include a clause permitting the custodians to loan the stock out.
custodians argue that by including this clause that they are able to maintain their fee at a lower rate, as they earn the additional fee from the shorting activity
