It’s so easy to write up such powerful contracts that give listed companies zero power of challenging it.
But when tested in a court the judge will no doubt decide this aspect cannot simply be relied upon as absolute.
Just like those crappy disclaimers various adventure operators use to ask you to sign to nullify any claims of negligence against the business. They are literally not worth the paper they’re written on.
I’m just so happy ISX are taking the ASX to court and this will change the way ASX operates and treats listed companies for the better.
The ASX will need to reconsider every action they take and consider litigation is a very real prospect if they do the wrong thing.
JK is a gutsy character and he must seek redemption for himself and all shareholders that have endured this fight.
