@gattertop I am wondering if I missed an answer to your question about ASX methodology on the court case.

I have thought that a body/person cannot appeal a case without a reason - i.e. that the judge did something wrong, new evidence has arisen etc. Therefore, if ASX does not defend the case, I would think that an appeal would not be open to it. My reasoning may just apply to appealing to the High Court, but I don't know for sure. Answer anyone?

I notice that ASX have not filed a defense yet nor have they filed a defendant's genuine steps statement which, according to the Federal Court Rules, must be completed by the "return date" on the applicant's genuine steps statement. I called the Victorian registry this morning to try to find out if there was a timeframe to file a defense and to try to find out what the the "return date" might be, but, as really expected, the person was pleasant enough, but I got no-where.

It would be interesting to know.
