well maybe ASX should have a better team to find the smoking gun - even after a few years ASX have nothing but a big headache... nothing - ASX don't even have their new chess system - which NSX had up and running a few years ago (blockchain, quick settlement etc).
spitballing - sure; action against an idea proposed by a sponsored research piece ? not a smart idea.
ASX agreed to the ISX bonus shares at the time of issue - didn't ASX do due diligence back then ?
the ~ $500mill damages ISX are suing ASX for, won't sting as much as the class action against ASX. If ASX lose the appeal, obviously ASX/ ISX will take this to high court.
Maybe ASX should have listened to their own legal team at the onset which warned about the potential litigation if they suspend ISX.
ASX just picked the wrong strong arm fight - going for a multinational profiting, expanding company, ISX have the funds to keep fighting; no win by attrition here.
