I think a TO can be anything, there is no floor for a TO bid that i'm aware of. Yes, it maybe a waste of time to offer less (if you're not Gina) knowing Gina likely won't accept an offer at a loss but an offer from Gina / Hancock can likely be anything and I'm not aware of any reason why the TO offer couldn't be less than her $3 purchases...it would actually make perfect business sense for her to average down and offer less if she was genuinely interested in owning the company.
She may get SQM to offer less and work out a deal with them. Who knows; you can speculate till the cows come home....but when they do it'll be interesting.
