Despite conceding it owes a ‘‘duty of care’’ to detainees, the government has argued it was indemnified from liability because camp operators were contractually obligated to provide ‘‘best-practice’’ care and facilities to the detainees. If someone was injured it was because the companies failed to adhere to their obligations in the contracts, the Commonwealth says.
