    "The ATO says employer obligations haven't changed and the tax should still be administered"

    Now i'm no legal expert BUT i thought that irrespective of an appeals process being lodged, the courts finding that the back packer tax is illegal stands. Now how is it that the ATO is allowed to keep collecting the tax after it was ruled illegal? Or is it that the ATO is exempt from complying with court findings?
