It appears that McGrathNocol are off and running, regardless of the legalities.
"Administrators handling the restructure of McAleese Group’s assets have confirmed that the firm’s Mackay and Rocklea depots in Brisbane will be closed.
However, the administrators have declined to confirm the date of the closure and how many workers will lose their job as a result of this move.
McAleese entered voluntary administration with McGrathNicol in late August.
Meanwhile, former directors Mark Rowsthorn and Donald Telford have resigned from the group effective September 30.
While administrators claim that they are continuing the review and trade of the business, the Federal Court of Australia has extended the date of the second meeting of creditors to March 28 next year.
Creditors were apprised of this during last month’s meeting, with administrators stating that it was considered appropriate under the circumstances to hold a meeting at a time when the "prospects of a restructure will not have been exhausted and creditors may be left with no viable alternative other than to place the Group into liquidation".
McGrathNicol had earlier stated that it was searching for a new date for the extraordinary general meeting (EGM) after the company went into administration."
