    Hi UT

    Any real estate agent that knows his/her job would never accept a contract that has "and or nominee" clause attached

    Its ok to have an "and" but when you put in "or" it enables the buyer to get out of the contract by making the nominee "Donald Duck" or some other fictitious person, it should only be used with the inclusion of another clause to say the person signing the contract agrees to complete the contract if the nominee doesn't.

    Also it would not be the ATO as the property sales tax is administered by the states, so maybe each state has their own rules
