I would only be guessing, but if this decision goes against them IMO they would struggle to find anyone to actually represent them in an appeal. They have already had a history of payment problems with their lawyers and no lawyer likes to take on an unwinable case. Especially one that has been advised as unwinable by the supreme court. Lawyers get business through winning cases not losing them so not a good look, especially if you are unlikely to get paid for your trouble. Just IMO of course.
