Doubt you would get the establishment fee refunded.
The establishment fee is for approval of the facility and preparation of associated documentation, which one would think would have been executed in readiness to drawdown once all loan conditions have been met.
A bank undertakes an application and preparation of submission to its credit dept/area for approval. Unless this was a negotiation before approval, any fee paid would be non-refundable.
