If everyone believed what they read !!!! Yet another aricle written by a misinformed journalist - happens all the time !!! Here are the facts as opposed to the assumptions.
1. Antanaskovic Hartnells fees are in the process of being "assessed" - this is perfectly normal practice and extremely sensible. Would you not query a bill if you thought it was too large !!!
2. Once assessed and agreed the bill gets paid by the litigation funder - simple.
3.Litigation funders name and engagement terms and conditions are not available at this time - they will be in due course - that was part of the engagement terms.
4.CHM are effectively fully funded and the case against MMX is likely to be March 2009 - the Koh/Evans case is scheduled for August 2009.
5.Piper Alderman were selected because they are extremely good in the area of dispute resolution - their succes rate is very high.
6.One should not expect any major movement in CHM at this stage. It is a possibility of course that there will be a serious dicussion regarding settlement nearer the March 2009 court date - MMX will of course hope that CHM run out of money etc etc - won't happen.
There you have it - should be fun and at 1c isn't exactly expensive!!!
