My view is the courts must decide on an outcome, they can’t just put it back for tender because you can bet that SMM will also tender. Then SMM will start the legal cycle all over again, because in their opinion, something wasn’t fair and right.
The court must decide on who’s tender was legal and fair. That’s why they get paid so much. But for the court to take this back to the beginning could become a legal nightmare.
And, if we lose the case (just for argument’s sake), couldn’t we sue the SI Government with a right to compensation?
