    that particular fact isn't being contested (well it is, kind of). Axiom have the landowners 100% no doubt about it.

    the main fact that is being contested is the dual LOIs that were released due a clerical error. LOIs have nothing to do with landowners unfortunately. SMM are suing the govt for this, with Axiom as a defendant.

    SMM thinks AVQ doesn't have any right to get the prospecting licence because, much like high school disputes, SMM was there first.

    could be wrong but that is what i took from the cases
