Imugene has done the same with Her-vaxx, tweaking the formulation and submitting new patents to extend IP life.

I cannot say for certain, but I am confident that the Ohio team is well aware of their patent situation and taking steps to update the B-vaxx IP and patents. Major new pharmacy products typically take many years from first invention, through clinical trials and on to market, so the need for patent renewal is common across all pharmacy development. In the USA the Hatch-Waxman Act could give them an extra 5 years form FDA approval, if they get that far, without even reformulating or improving the technology.

I'm not at all saying that B-vaxx will get that far, of course. My posts on B-vaxx are just to highlight the breadth of the IP now held by Imugene, and the potential for B-vaxx to be a surprise when the Phase 2 trial is completed and the results are released. My posts are in the interests of promoting discussion and perhaps drawing out new comments and perspectives. Certainly IP is vital, and your comment is an important one to consider. Can you advise which interview Leslie mentioned this in? I would be interested to go back to it.
