Only "covered" shorting is legal and it is within certain caveats/ confines and some commentators believe that when goes through the actual date of ownership and transfer and the precise sequencing of the short transaction(s) individually - probably only about 40% would have been done within compliance with the regs. With automated trading and cascading of very tiny numbers of shares but in great volume the whole process is reduced to virtually self-reporting of the particular short sale ... AS IF .. Clearly, you trust that the ASX/ ASIC to be on the case ...
