It is so much simpler here in the U.S. Purchases 30 days before or after a loss means a wash sale, and the basis of the purchase is adjusted accordingly. Nothing illegal about the wash sale, just an accounting adjustment and simple 30 day rule. Nobody needing to make judgements about motives...
