Unsurprising. No doubt costs are not awarded due to the public interest nature of the claim, no matter how tenuos the claim.
Strangely enough this public interest argument is often found in the Family Court where shy applicant has nothing to fear about costs orders.
I wonder if F & B will be back to oppose the expansion of the escarpment mine on the grounds that the hew ground is different from the approved ground.
