Neither is the Chinese stupid and get stuck at a deadlock. It's not in China's interest. They know despite the SEEMINGLY favourable decision, the Australian state and federal government know Communist China is driving the agenda and this is as good as it gets for the China.

Soon, they will do the right thing and acceptable commercial terms regardless of the ERA thresholds.
