Regardless, is this likely to be successful?
They've been recruiting since the beginning of the year now and have got "nearly 260" lawsuits. Back in July the number was 150 and in an interview in the AFR Ross Dobinson dismissed it as "It’s hardly being swamped".
The FDA has already stated there's no consistent evidence to support what every single one of those lawsuits alleges.
