My understanding is that what you have quoted does not come from the gold purchase agreement but a clause elsewhere relating to Besra's insolvency and the liability to Quantum. Which would be academic anyway as Besra would be insolvent.
It would be a deeply flawed agreement that if Quantum went under Besra in turn went bankrupt. In fact Besra can terminate the agreement by paying the cash back (with interest).
