    "In July 2004, the German Federal Patent Court found the claims of the relevant German patent could not be maintained over certain prior art cited by Deutsche Telekom. In September 2004, ipernica lodged an appeal to the German Federal Supreme Court against this decision and the final appeal hearing and ruling is now set for 23 September 2008"

    I read this as final decision tonight.
