I'm not going to look for confirmation right now but from memory the non-refundable deposit is refundable if Delta share holders say "No".
However remember that Deltaplc is the majority share holder in DeltaEMD and Deltaplc has agreed to sell. I don't see any problem with DeltaEMD agreeing to the sale since the majority share holder has already agreed to sell..
Also remember that care and maintenance was costing Intec $70,000 to $80,000 a month for the Hellyer mill. I wonder what the cost to Delta is per month for the plant. From memory it has been on care and maintenance since March last year.
Anyone can check the above and I will be pleased to hear any results.
