Biota CEO, Peter Cook, likened his company losing an ongoing lawsuit against GlaxoSmithKline (GSK) to taking a hit from a meteor on 19 June 2008. Biota is suing GSK for between $A564 million and $A704 million over claims the company failed to use "best efforts" to commercialise its Relenza drug. According to Smith, GSK failed to take advantage of the "leader's opportunity" the drug provided and eventually sought to terminate their partnership. Cook said the odds of Biota losing the case were such that he had not lost sleep worrying about the possibility
