It is a minefield with many many patents and references to discovery of various polymerase (NS5B) inhibitors in relation to HCV going back a decade and more.

I think the best we can say at this point is that the personnel behind Biota's work have a strong and deep background of very specific discovery in relation to these inhibitors.

Biota might be called on to prove the origins of their invention, unless there is already clear evidence of this, in which case, Biocryst will have to demonstrate that their discovery came first.
