Unofficially settlement is on the go, my suspicitions have been confirmed, $13.4 million sub-royalty payment to the CSIRO and Victorian College of Pharmacy is (1% of 7% is actually 14.3%) according to TJW,s post, that means Biota are getting 100% from GSK.

In essence Biota,s demands from GSK in getting their IP (International Property) back for Relenza have succeeded, but are not finalised yet................I suspect we will get an announcement in September, as the Victorian Supreme Court mentioned that is when the case File 5670 is going to be reinstated on their lists and the courts require a month to lodge papers for a settlement between two parties that have settled out of court, so would say from the date of GSK lodging there Defence Claim or thereabouts they would have lodged Settlement Documents.

I did think this was going to occur, but it is FANTASTIC news, AT LAST.............. I would think the (Blacked out pages) on GSK Defence document, were the first clue something was up, especially when the court didn,t request them to be removed, the second clue was the Victorian,s Supreme Court removal of the Case File and the Biota,s briefing document, I wondered where an intangable amount came from and it just didn,t add up.

Well this is wonderful news, even though it is not official, just look at all the evidence, the Blacked out pages, was daming evidence of proof of GSK,s deliberate action to squash Relenza, fortunately for Biota Bird flu came along at a most opportune time and GSK have been caught out big time.

And from Biota,s Briefing, I would say how Biota know Relenza is going to be vamped up further is they are going to be in control.

    Cheers dma
