In regard to the first point, I believe success here will demonstrate a case for complimentary use cases. I also wonder if the market segmentation and delivery method,.portability, tolerance etc will ultimately be as relevant as end efficacy.
Legal technicality re the latter, and I gather its more complex then will be presumed either way here, but it would seem counter-intuitive to me to provide IP 'coverage' to facilitate medical advances in recognition of the cost and difficulty of development. See demonstrated progress then decline extension... cant see it logically
