Won't happen. ASX can never be liable. You can't designate criteria for compliance triggers in such varied and complex matters handled in ASX news releases. ASX won't want to make themselves criminally subject to anything that slips through, nor would they be able to resource themselves to capture everything. Furthermore, if there are cops at the gate, the companies will just shift to other exchanges.
