TEROPONGBULUSARAUNG. COM, WAJO – The Branch Management Council (DPC) of the Mining and Energy Federation (FPE) Confederation of Indonesian Prosperous Trade Unions (KSBSI) Wajo Regency visited the Wajo DPRD, Wednesday (5/10/2022).
This is done in relation to the issue of Termination of Employment (PHK) which will be carried out by the management of PT. Energi Sengkang after the end of the contract between PT Energi Sengkang and PT PLN, made the workers restless.
Chairman of the KSBSI FPE DPC, Kadir Nongko said, the discourse on layoffs was very troubling for employees. Moreover, the management of PT Energi Sengkang had conveyed the discourse on layoffs during a meeting some time ago.
“There are about 70 workers who were forced to take their severance pay. Because if they don't, they say diesel fuel will run out," said Kadir.
Kadir also asked the DPRD to immediately hold a Hearing Meeting (RDP) and summon all relevant parties including the Manpower Office, Kesbangpol, and PT. Energi Sengkang.
"We ask the Wajo Regency DPRD to seriously address this issue so that there are no unilateral layoffs by the management of PT Energi Sengkang. Moreover, the workers are permanent employees," he hoped.
Kadir also explained that it was not permissible for the company to carry out mass layoffs, especially without the workers' consent. In the Constitutional Court decision number 19/PUU-IX/2011, a company can only do layoffs if the company is permanently closed.
“This is the contract with PLN that has ended. But the company continues to operate, he said.
Kadir even suspected that these employees were deliberately laid off to recruit new employees.
Responding to this aspiration, Member of the Wajo DPRD, Zainuddin Ambo Saro said, there is a procedure for terminating employment. Moreover, the worker is a permanent employee, not a contract.
“It is true that one cannot lay off workers unilaterally. There must be procedures including workers entering retirement age or asking themselves to stop and companies closing permanently," he said.
Meanwhile, another member of the Wajo DPRD, Mustari said, as soon as possible he would follow up on the aspirations of Commission IV to hold an RDP by inviting PT. Energi Sengkang.
