The way I see it .. the guys in the US took legal action over there because they were presented with apparently dodgy SEC(?) filed documents. So I suppose Aus shareholders would need to find similar misleading documents presented to the ASX or released to shareholders.
And I think the US doc was aimed at sophisticated investors... which I presume that is why Aus shareholders were out of the loop.
And I think you would need some pretty convincing evidence before proceeding to have a chance of success.... good luck with that!
