Well not really
If unconscionable conduct can be proved against Green and his co horts in BNB that the management contract made with BBP is harsh and oppressive designed to gain an advantage for BNB then the management contract can be made void.
It is argueable now that Greens behavior has been harsh and oppressive towards BBP which has had a result of providing an unfair advantage for himself and certainly BNB.
It can fairly certainly be proven that BNB did not advise BBP that BNB would gouge fees out of BBP that would have the effect of leaving shareholders in BBP with a -ve asset value.
