Hi all
Re: stamp duty implications
Prior to getting 'costly' legal advice it might be worth checking with the SA state revenue office to see if they have recently come out with details about the 'instalment warrant arrangements' for super and impact on stamp duty in SA. Even if you have previously checked with them.
I know the Vic SRO have reviewed and issued details about this recently (13 Feb 2009), because of the confusion that was occurring, refer to:
http://www.sro.vic.gov.au/sro/SROWebSite.nsf/taxes_duties_act_warrant.htm
I haven't had a chance to look at this review yet, will do shortly. Not pertaining to SA but may give a hint as to what to look for in the SA stamp duty instruments, ie references to consideration requirements etc.
Though again may be worthwhile checking with SA SRO as to whether they have issued any clarifications as per VIC SRO's.
