i would guess - how do we settle this thing without actually showing up to court in Sept.
Govt will be mindful of setting a precedent.. a court case that MAY go against them and sets a precedent for others to follow and use - is NOT something they will want. Better to ahve it keep it grey that they can do as they like and drag it out for years without any 'liability'
