For my own lack of knowledge - i thoguht I would find out what a 'hearing' is in the Federal Court for Assets PREVIOUS court action back in 2022..... you know the one Justice Jackson Quashed!... IT NEVER made it to a hearing - but this is what it could have happened in that hearing. The Hearing Itself:
Opening Statements: Each party’s legal representatives (barristers or solicitors) present an overview of their case. Asset Energy likely argued that Morrison’s decision was biased, lacked procedural fairness, and was politicized, as stated by their executive director, David Breeze. The Commonwealth, represented by the government’s legal team, would defend the decision, possibly arguing it was lawful and based on community opposition. Presentation of Evidence: Evidence, such as affidavits, documents, or witness testimony, is presented. In this case, Asset Energy’s affidavit included Morrison’s media conference transcript from December 16, 2021, where he cited community opposition as a reason for rejecting PEP-11. Witness Testimony (if applicable): Witnesses may be called and cross-examined. For this case, it’s unclear if witnesses were called, as judicial review cases often rely on documentary evidence rather than live testimony. Legal Arguments: Lawyers argue their interpretation of the law. Asset Energy likely claimed the decision breached administrative law principles (e.g., procedural fairness or improper exercise of power), while the Commonwealth would argue the decision was within the minister’s authority under the Offshore Petroleum and Greenhouse Gas Storage Act 2006. Judicial Questions: The presiding judge (or judges, if a Full Court) may ask questions to clarify points of law or fact.
SOoOo...I assume it will be similar this time IF we get to court....BRING ON the WITNESSESSSS!!!!
