"These disclosures have IMO put the current Government in an unwinnable position", I agree, in my opinion, it is pretty much case closed.

My analysis of the court case previously was that the Government lawyers were not going to drop it, and they were clearly not giving up any ground. They even made sure to correct the applicant when they discussed the genuine steps statement, which is very proactive.

However, Its pretty clear what has occurred, they may very well drop the case if deemed unwinnable.

The timing is perfect for this Hon Virginia Bell report, as the applicant (Asset Energy) can include it into the Federal Court case, as the time for additional submissions closes 30/11/2022 for the Federal Court case: "9. On or before 4.00 pm AWST on 30 November 2022, the applicant must file and serve any affidavits in reply on which it intends to rely at the hearing of the matter."
