I'd have thought unless you mean customer = Lynas + Consulting Engineer, otherwise in engineering aspect: Lynas > Consulting Engineer > Contractor.

So the Mechanical & Electrical Consultant firm (Consulting Engineer) which is responsible for the Design & Works Supervision ++ is to bear any responsibilities for the faults or failures if that can be called, unless of cause Lynas overruled them, to which it's not a norm.

Rhodia, as in this case who provide the chief engineering design could be the one, if not the only one, to bear the most, if not all, of the responsibilities.
