    I don't think thats how class actions work Jasper. Usually by suing management you are expecting it to be covered by the insurance cover which they use shareholders funds to pay for. I can't recall the name of the policy type but its something like inept, incompetence and idiocy insurance. There is no point shareholders suing themselves which is what happens when they sue a company that they are a shareholder in. They need to sue management for breaching their responsibilities, ie specific failures which cause the shareholders losses. If the board breached its obligations and consequential damaged can be ascertained then that's usually covered by insurance.
