Hi A2,
I'm on your side mate. I'd like to see directors of many companies held to account and share in the pain equally with shareholders. Don't take anything that I say as suggesting otherwise. Your post was very long and contained a lot of different point so I will try and address them as best I can. Its important that we compartmentalize parts of this conversation to make it understandable. I hope you don't mind.
Firstly you mentioned both the ASX and the ATO. As I explained previously the ASX is a private company and their regulatory role is limited. For the purposes of this conversation their role is merely to make sure companies meet their reporting obligations, listing rules etc as well as perform some market surveillance. Don't waste your time on the ASX here and they really have no responsibility for most of what you are suggesting.
The ATOs role is collect taxes on behalf of the federal government as well as some role in rebates. Their job is not to determine if Biotron's science is good, if they had a good chance of commercialization, or if MM is telling porkies to shareholders. They don't even have scientists to read the trial results. They merely administer the government's policy which is to rebate R&D claims for certain classifications of company. Just like your tax return, if the auditors signed it off then the ATO isn't looking into it. These aren't grants, they are R&D rebates and according to government policy and the law I don't have any reason to believe that Biotron wasn't entitled to the money. That said you could argue that the government are idiots and their policy sucks but thats not going to help in getting Biotron held to account is it?
You also mention ASIC and that is the only entity mentioned that is actually relevant here. If you have any evidence that Biotron, it officers or entities associated with it have acted inappropriately then please do send that info to ASIC. Like I said to Jasper it has to be actual evidence, not emails saying "MM sucks" or "the thieves stole my money".
