You're probably right, but in fairness there was nothing obvious to tell them otherwise.
I assume when BCSCA was origionally issued ($1.00 down with two more $1.00 installments due) that a prospectus was issued and written aplication had to be made. The conditions were made plain to all prospective purchasors. However from then on BCSCA can be traded without those conditions displayed, and as most of us these days trade online, well here we are.
Perhaps the warrants agreement can be expanded to include other high risk items such as this type of contributory.
