    I remember some discussion about this last year.

    If I remember correctly the weak spot to be focusing on is that technically by withholding second level market depth and broker ID the brokers have what amounts to privledged information. This is important purely because as they may be trading against you as a retail trader they have access to what is effectively inside information that is not generally available to other market participants.

    For example if first level market depth is 200000 shares for sale and 20 sellers (which is all we can see) but the broker knows that 180000 of those belong to one seller who is constantly replenishing his position, that information, which you would not otherwise have, could well influence your decision as to whether to buy...and numerous other derivatives of the same thing if you know what I mean...

    To reiterate, the issue is, does withholding this information beneficially prejudice trading in the market in favour of dealers and institutions. If it is likely that it does (and clearly it does) then you have a case imo.
