As were many of us shareholders S2O. However, why would Eric ever do that and take away the company's flexibility. While I want the shortfall shares to lapse, I'd lose all faith in Eric if he did something as silly as announcing that the company would not issue those shares. That overhang may be a key consideration preventing an opportunistic takeover attempt from being launched at this very moment - and every day gets us closer to testing. While I was really disappointed with Eric not taking up any shares, I've gotten over it. He's still got somewhere in the vicinity of 20 mil doesn't he? To suggest he's not working on growing the share price/company just doesn't make sense. I also do think Eric's may be having a bit of a dust up with ORG, but my respect for Eric has only grown from his handling of this (particularly if they're trying to low-ball us on Yulleroo). Eventually ORG has to do something as otherwise, as other posters have mentioned, a claim of breach of the JV agreement for bad faith will eventually arise.
